This article discusses the merits of teaching legal analysis and writing and of developing a legal writing program at a faculty of law, and recommends that law faculties around the world incorporate this subject. Once absent from the American law school curriculum, this subject has become a required subject in all American law schools over the past 25+ years. The article suggests steps for implementing a legal writing course or program, and offers a variety of resources for doing so.

Biomedical diagnostic science is a great deal less successful than we've been willing to acknowledge in bioethics, and this fact has far-reaching ethical implications. In this article I consider the surprising prevalence of medically unexplained symptoms, and the term's ambiguous meaning. Then I frame central questions that remain answered in this context with respect to informed consent, autonomy, and truth-telling. Finally, I show that while considerable attention in this area is given to making sure not to provide biological care to (...) patients without a need, comparatively little is given to the competing, ethically central task of making sure never to obstruct access to biological care for those with diagnostically confusing biological conditions. I suggest this problem arises from confusion about the philosophical value of vagueness when it comes to the line between biological and psychosocial needs. (shrink)

This study described the relationships between academic class and student moral sensitivity and reasoning and between curriculum design components for ethics education and student moral sensitivity and reasoning. The data were collected from freshman (n = 506) and senior students (n = 440) in eight baccalaureate nursing programs in South Korea by survey; the survey consisted of the Korean Moral Sensitivity Questionnaire and the Korean Defining Issues Test. The results showed that moral sensitivity scores in patient-oriented care and conflict were (...) higher in senior students than in freshman students. Furthermore, more hours of ethics content were associated with higher principled thinking scores of senior students. Nursing education in South Korea may have an impact on developing student moral sensitivity. Planned ethics content in nursing curricula is necessary to improve moral sensitivity and moral reasoning of students. (shrink)

It is not widely realised that Turing was probably the first person to consider building computing machines out of simple, neuron-like elements connected together into networks in a largely random manner. Turing called his networks 'unorganised machines'. By the application of what he described as 'appropriate interference, mimicking education' an unorganised machine can be trained to perform any task that a Turing machine can carry out, provided the number of 'neurons' is sufficient. Turing’s analysis of computability has recently been challenged; it is claimed that it is circular to analyse the intuitive concept of numerical computability in terms of the Turing machine. This claim threatens the view, canonical in mathematics and cognitive science, that the concept of a systematic procedure or algorithm is to be explicated by reference to the capacities of Turing machines. According to the Perceptual Symbols Theory of cognition (), modality‐specific simulations underlie the representation of concepts. A strong prediction of this view is that perceptual processing affects conceptual processing. In this study, participants performed a perceptual detection task and a conceptual property‐verification task in alternation. Responses on the property‐verification task were slower for those trials that were preceded by a perceptual trial in a different modality than for those that were preceded by a perceptual trial in the same modality. This (...) finding of a modality‐switch effect across perceptual processing and conceptual processing supports the hypothesis that perceptual and conceptual representations are partially based on the same systems. This paper argues that some words are so highly charged with meaning by a community that they may prevent a discussion during which each participant is on an equal footing. These words are indeed either unanimously accepted or rejected. The presence of these adjectival groups pushes the antagonist to find rhetorical strategies to circumvent them. The main idea we want to develop is that some propositions are not easily debatable in context because of some specific value-bearing words, and one of (...) the goals of this paper is to build a methodological tool for finding and classifying these VBWs. Our study echoes the importance of “cultural keywords” in argument, but is rather based on a German approach developed by,, and about “Miranda” and “Anti-Miranda” words that is expanded and refined here. In particular, our study tries to understand why some statements, fueled by appreciative or evaluative adjectives, have such rhetorical effects on a pragmatic level in the particular context of a vote on the Swiss popular initiative called “for more affordable housing”. This context is fruitful since two parties offer reasons for two opposing policy claims: namely, to accept or to reject an initiative. When one party uses arguments containing such universally unassailable adjectival groups to defend a “yes” vote, the opposing party cannot use a symmetrical antonym while pleading for the “no” vote. The methodological tool that is proposed here could shed light on the use of certain rhetorical and referential strategies in conflicting policy proposition contexts. (shrink)

Many sign languages display crosslinguistic consistencies in the use of two iconic aspects of handshape, handshape type and finger group complexity. Handshape type is used systematically in form-meaning pairings (morphology): Handling handshapes (Handling-HSs), representing how objects are handled, tend to be used to express events with an agent (“hand-as-hand” iconicity), and Object handshapes (Object-HSs), representing an object's size/shape, are used more often to express events without an agent (“hand-as-object” iconicity). Second, in the distribution of meaningless properties of form (morphophonology), Object-HSs (...) display higher finger group complexity than Handling-HSs. Some adult homesigners, who have not acquired a signed or spoken language and instead use a self-generated gesture system, exhibit these two properties as well. This study illuminates the development over time of both phenomena for one child homesigner, “Julio,” age 7;4 (years; months) to 12;8. We elicited descriptions of events with and without agents to determine whether morphophonology and morphosyntax can develop without linguistic input during childhood, and whether these structures develop together or independently. Within the time period studied: (1) Julio used handshape type differently in his responses to vignettes with and without an agent; however, he did not exhibit the same pattern that was found previously in signers, adult homesigners, or gesturers: while he was highly likely to use a Handling-HS for events with an agent (82%), he was less likely to use an Object-HS for non-agentive events (49%); i.e., his productions were heavily biased toward Handling-HSs; (2) Julio exhibited higher finger group complexity in Object- than in Handling-HSs, as in the sign language and adult homesigner groups previously studied; and (3) these two dimensions of language developed independently, with phonological structure showing a sign language-like pattern at an earlier age than morphosyntactic structure. We conclude that iconicity alone is not sufficient to explain the development of linguistic structure in homesign systems. Linguistic input is not required for some aspects of phonological structure to emerge in childhood, and while linguistic input is not required for morphology either, it takes time to emerge in homesign. This article aims at achieving a detailed qualitative vision of the chronic disease in the adolescent population and its specific issues. To that end, a first-person experiential research based on significant events regarding healthcare pathways was developed. Six interviews were conducted with three practitioners. The results of this researchallow us to identify spaces of configuration in terms of parenthood, of therapeutic alliances and of negotiating care strategies between teenagers, parents and professionals.Which co-construction spaces should be built with the teenagers in (...) conflict or in rupture or with the suffering parents? What position on dualism does medicine require? Our understanding of that ques- tion has been dictated by holism, as defined by the biopsychosocial model, since the late twentieth century. Unfortunately, holism was characterized at the start with con- fused definitions of ‘dualism’ and ‘reductionism’, and that problem has led to a deep, unrecognized conceptual split in the medical professions. Some insist that holism is a nonreductionist approach that aligns with some form of dualism, while others insist it’s a reductionist view (...) that sets out to eradicate dualism. It’s important to consider each version. Nonreductive holism is philosophically consistent and clinically unprob- lematic. Reductive holism, however, is conceptually incoherent—yet it is the basis for the common idea that the boundary between medical and mental health disorders must be vague. When we trace that idea through to its implementation in medical practice, we find evidence that it compromises the safety of patient care in the large portion of cases where clinicians grapple with diagnosis at the boundary between psychiatry and medicine. Having established that medicine must embrace some form of nonreduc- tionism, I argue that Chalmers’ naturalistic dualism is a stronger prima facie candidate than the nonreductive alternatives. Regardless of which form of nonreductionism we prefer, some philosophical corrections are needed to give medicine a safe and coherent foundation. (shrink)

This study provides insight into factors that determine whether women in the college population who exhibit eating-disordered behavior during their college years recover during their postcollege years. The study assessed changes in the eating patterns of 21 women across a six-year time period, from sophomore year in college to two years postcollege. Eleven of the women get better during their postcollege year, whereas 10 of the women continue to struggle with disordered eating. The major differences between the two groups revolve (...) around the relationship between autonomy and relation. Women who get better negotiate the tension between autonomy and relatedness and are more likely to have higher selfesteem based on a more positive self-concept; this, in turn, leads to healthier relationships with food and body image. Two factors that appear to influence this negotiation include one's history of chronic physical or sexual abuse and the quality of familial messages about food, body image, relationship, and autonomy. The commentaries have led us to entertain expansions of our paradigm to include new theoretical questions, new criteria for what counts as a gesture, and new data and populations to study. The expansions further reinforce the approach we took in the target article: namely, that linguistic and gestural components are two distinct yet integral sides of communication, which need to be studied together.

AbstractIntegrity is considered an important corporate value. Yet recent global events have highlighted the challenges firms face at living up to their stated values, especially when extended supply chain partners are involved. The concept of Supply Chain Integrity (SCI) can help firms shift focus beyond internal corporate integrity, toward supply chain integrity. Researchers and managers will benefit from an understanding of the SCI concept toward implementing SCI to better align supply chain partners with stated corporate values. This research fully develops (...) and empirically grounds the firm-level, inter-firm-oriented SCI concept. The thematic analysis of six firms’ archival and website content elaborated empirical descriptions of SCI themes and enabled the development of a process model for SCI, presenting a novel view of the underlying process by which firms can assess, develop, and maintain SCI across their supply chains. We propose the SCI model as an evolutionary process to improve a firm’s supply chain sustainability, rather than a dichotomous end state where firms either “have” integrity or they don’t. The SCI model could be used as a tool to help leaders create necessary change to better align values and supporting statements with culture, while influencing and affecting stakeholders across the supply chain. This is particularly important in today’s world, where business leaders must consider all stakeholders and address important stakeholder-driven issues such as supply chain sustainability, resilience, and security, which are now at the forefront in the ever-changing environment. Chomsky's “revolution” and the revolution in sign language linguistics began around the same time, but they did not directly affect each other for a while. This chapter focuses on Chomsky‐inspired research on sign language grammar and the ways that the study of sign languages connects to theories of innateness, the two main ways that Chomsky's impact has been felt in sign linguistics. Chomsky's linguistic legacy has two primary arms: one in theories of syntax, and the other in theories of language (...) acquisition. Chomsky's strong claim is that the input provided to young children acquiring their native language is too poor to constitute a complete inductive basis for general cognitive learning principles to succeed. Specifying the content of the “language acquisition device” has been a central concern of Chomskian linguistics. (shrink)

Recently, novel lines of research have developed to study the influence of identity processes in sport-related behaviours. Yet, whereas emotions in sport are the result of a complex psychosocial process, little attention has been paid to examining the mechanisms that underlie how group membership influences athletes’ emotional experiences. The present narrative review aims at complementing the comprehensive review produced by Rees et al. (2015) on social identity in sport by reporting specific work on identity-based emotions in sport. To that end, (...) we firstly overview the different terminology currently used in the field of emotions in groups to clarify the distinct nature of emotions that result from an individual’s social identity. Secondly, we discuss key concepts of social identity to better understand the mechanisms underlying identity-based emotions. Thirdly, we address existing knowledge on identity-based emotions in sport. We close the present narrative review by suggesting future research perspectives based on existing meta-theories of social identity. Evidence from the social psychology literature is discussed alongside existing works from the sport literature to propose a crucial theoretical approach to better understand emotions in sport. An important part of friendships are the so-called special obligations generated by them. Friends owe things to each other that they do not owe to strangers. While such special obligations are an important part of our everyday practice, they raise several philosophical questions. These questions include the status of special obligations (are such obligations sui generis or is it possible to reduce them to general moral principles?), the source of such special obligations (what grounds special obligations of friendship?), and the (...) content of special obligations (what is the content of special obligations of friendship?). Cet ouvrage pose la question de la construction de sens au cours de religion catholique de Belgique francophone, avec une proposition qui concerne plus particulièrement les élèves de la fin du secondaire et leurs enseignant·es. Trois fils rouges guident le travail, qui lui confèrent une coloration spécifique. Le premier a trait au sens, entendu dans son acception la plus large, qui va du sens du langage au sens le plus ultime, en passant par le sens tel qu'il se décline au (...) coeur d’une existence. Le suivant renvoie à l’articulation entre la construction et la transmission d’un sens, la première expression se rapportant à la pratique des communautés de recherche, la seconde s’inscrivant dans l’acception classique du terme en lien aux savoirs. Le dernier fil conducteur est relatif à l’association de deux disciplines essentielles pour le cours: la philosophie et la théologie, avec une insistance sur la philosophie comme mode de vie et quête de sagesse, à rapprocher de la quête de sens, mais également sur l’intérêt d’introduire les jeunes à une forme de silence et d’introspection. Throughout their history, symbolic interactionism and critical perspective have been viewed as divergent theoretical perspectives with different philosophical underpinnings. A review of their historical and philosophical origins reveals both points of divergence and areas of convergence. Their underlying philosophies of science and views of human freedom are different as is their level of focus with symbolic interactionism having a micro perspective and critical perspective using a macro perspective. This micro/macro difference is reflected in the divergence of their major concepts, goals (...) and basic tenets. While their underlying philosophies are different, however, they are not necessarily contradictory and areas of convergence may include the concepts of reference groups and looking glass self within symbolic interactionism and ideological hegemony within critical perspective. By using a pragmatic approach and combining symbolic interactionism and critical perspectives, both micro and macro levels come into focus and strategies for change across individual and societal levels can be developed and applied. Application of both symbolic interactionism and critical perspective to nursing research and scholarship offers exciting new opportunities for theory development and research methodologies. In nursing education, these two perspectives can give students added insight into patients' and families' problems at the micro level while, at the same time, giving them a lens to see and tools to apply to problems at the macro level in health care. In nursing practice, a combined symbolic interactionism/critical perspective approach assists nurses to give high-quality care at the individual level while also working at the macro level to address the manufacturers of illness. New research questions emerge from this combination of perspectives with new possibilities for theory development, a transformation in nursing education, and the potential for new practice strategies that can address individual client and larger system problems through empowerment of clients and nurses. In 2006, the University of Maryland Carey School of Law had the privilege of co-hosting the annual Health Law Professors Conference with the American Society of Law, Medicine & Ethics (ASLME). Coincidentally, as director of the Law & Health Care Program at Maryland, I had the opportunity to announce the winner of the Jay Healey Health Law Teachers’ Award at the conference. The award is given to “professors who have devoted a significant portion of their career to health law teaching (...) and whose selection would honor Jay [Healey’s] legacy through their passion for teaching health law, their mentoring of students and/or other faculty and by their being an inspiration to colleagues and students.”1 Healey, a Professor in the Humanities Department at the University of Connecticut School of Medicine, was the youngest recipient of the Society’s Health Law Teachers’ Award, which he received in 1990. He was passionate about teaching and had the idea to devote a session each year at the annual conference to teaching health law. It was always a plenary session at which he challenged us to be better teachers. Jay died in 1993, at the age of 46, not long after the Health Law Teachers conference that year, which he attended and which also happened to be held in Baltimore at the University of Maryland School of Law. Early educators are in a bind. Teacher education programs are calling on them more and more to help students practice critical thinking and develop intellectual character ; yet school funding depends on meeting Common Core standards, which do not explicitly assess critical thinking until the high-school level. Add to that an over-engineered content curriculum, and thinking becomes a luxury that is quickly lost amid more immediate concerns. As a result, we are raising a generation of “excellent sheep” who flourish amid (...) standardized tests but are increasingly unable to think for themselves. The problem, we suggest, is that today’s teachers are in such a rush to give students the answers that they are not allowing them time to ask the questions. As a result, students cannot find the “deep structure” of issues. Bodies of knowledge thus strike them as disconnected facts, quickly forgotten. The solution, as suggested by recent work in cognitive science, is to teach critical thinking through teaching content. In what follows, we propose a way of organically integrating content and thinking through games, story books and art. With this, we put children into the driver’s seat, encouraging them to ask their own questions, to propose their own answers and to join their peers in joint inquiry through dialogue. In a word, we propose teaching children philosophy as early as possible. Tom Wartenberg has made considerable progress with his picture-book philosophy curriculum designed for elementary schools. But what of younger children? Combining the resources of Rollins College’s Philosophy Department and Child Development and Student Research Center, we set out to find “how low can we go?” Over four terms’ of trial and error, we have adapted and distilled Wartenberg’s methods into a model that works for the Center’s 4-year-olds, and we have tested this model on a larger scale through a one-term collaboration with the Winter Park Day Nursery. The global pandemic has intensified the risk of moral distress due to increased demands on already limited human resources and uncertainty of the pandemic’s trajectory. Nurses commonly experience moral distress: a conflict between the morally correct action and what they are required or capable of doing. Effective moral distress interventions are rare. For this reason, our team conducted a multi-phase research study to develop a moral distress intervention for pediatric critical care nurses. In this article, we discuss our multi-phase approach (...) to develop a moral distress intervention—proactive, interdisciplinary meeting. Our proposed intervention is a sequential compilation of empirical work couched within a relational ethics lens thus should point to enhanced potential for intervention effectiveness. (shrink)

Over twenty years have passed since JLME published “The Girl Who Cried Pain: A Bias Against Women in the Treatment of Pain.” This article revisits the conclusions drawn in that piece and explores what we have learned in the last two decades regarding the experience of men and women who have chronic pain and whether women continue to be treated less aggressively for their pain than men.
